Hereinafter referred to as the "Photographer".
1. Ordering Photographic Services
1.1. Photography sessions can be booked via social media (Facebook, Instagram), through the contact form, by phone, SMS, or email.
1.2. A deposit of 1,000 CZK is required before the photoshoot. If the session is canceled at least 3 days before the agreed date, the deposit is forfeited. In case of adverse weather, the session can be rescheduled upon agreement.
1.3. By placing a binding order, the client confirms that they have read and understood these terms and conditions and are familiar with the photographer's style.
2. Selection and Editing of Photographs
2.1. Clients will receive photo previews no later than the day after the session. The number of preview photos is not fixed.
2.2. Clients select their photos through the server nahledovky.cz.
2.3. According to Copyright Law No. 121/2000 Coll., unedited previews may not be shared or published and are intended solely for client selection. Screenshots, photos of monitors, or print screens are not allowed.
2.4. Event and wedding photos are selected by the photographer. The number of photos for a half-day session or small wedding package is 150–300, and for a full-day session or large wedding package: 300–500.
2.5. Clients have two months for their first photo selection. If the first selection is completed within this period, they may make additional selections at any time within the following six months, by arrangement.
2.6. The photographer does not provide unedited photographs.
2.7. Editing of photographs is exclusively at the discretion of the photographer, reflecting their unique style and skill. Exceptions are only made by mutual agreement.
3. Delivery of Photographs
3.1. Clients will receive the photographs no later than 14 days after submitting their selection. In case of illness or other complications, delivery may take up to one month.
3.2. Clients will receive photographs in digital form in two qualities — full resolution for print and reduced resolution for social media.
4. Payment
4.1. Clients pay a deposit of 1,000 CZK before the photoshoot according to the payment details provided on the invoice. The deposit is then deducted from the final price of the selection.
4.2. Clients may make payment via the attached QR code when submitting their selection. The photographer provides an invoice upon request.
4.3. Edited photographs are usually delivered only after full payment.
5. Complaints
5.1. Complaints are only accepted regarding the number of photographs or issues opening the files.
5.2. Complaints about photo editing (aesthetic quality) are not accepted — clients are required to familiarize themselves with the photographer's style.
6. Copyright and Use of Photographs
6.1. The photographer remains the owner of the photographs according to Copyright Law No. 121/2000 Coll. The photographer may use the photographs for any purpose at any time. If a photograph is published, the client is generally informed in advance — however, the client has no further claims against third parties.
6.2. The photographer is not obliged to notify clients in advance about publication on social media.
6.3. If the client does not wish to be published, they must notify the photographer in advance. The client has the right to request removal of photographs.
6.4. It is forbidden to present preview photographs publicly.
6.5. Photographs may not be further edited or provided to third parties.
6.6. Photographs may not be used for commercial purposes or sold to third parties without written consent of the photographer, including photo contests.
6.7. Purchased photographs are for private use only — printing for personal use, publishing on personal non-commercial social media pages.
6.8. Purchased product photographs (by companies) may be used for commercial purposes.
7. Vouchers
7.1. Purchased vouchers are valid for 6 months from the date of purchase and are non-refundable.
7.2. If the voucher is not redeemed within this period, it expires in favor of the photographer.
8. Personal Data Protection (GDPR)
8.1. Under the European General Data Protection Regulation (GDPR), you are informed about the scope of processing your personal data. Only necessary personal information is required, such as full name, email address, and phone number. This data is used for processing the order and delivering the completed work. Client data is stored only for the necessary period and is not accessible to unauthorized persons.
8.2. Personal data provided by the client is not used for marketing, newsletters, and is not shared with third parties.
9. Damages
9.1. If the client or their companions cause damage to the photographer's equipment or other property, they are fully responsible for covering the cost.
